Acceptance of Terms

By accessing or using Sortmarks, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the service.

Description of Service

Sortmarks is a web-based tool that organizes browser bookmarks using AI technology. You upload a bookmarks file, and we return an organized version. The service is provided "as-is" without warranties of any kind.

User Responsibilities

You agree to:

• Use the service only for lawful purposes
• Not attempt to abuse, overload, or exploit the service
• Not upload malicious content or attempt to breach security
• Respect rate limits and usage quotas
• Not use the service to process data you don't have rights to

Pricing and Payment

Sortmarks is a paid service with tiered pricing based on the number of bookmarks you want to organize. All payments are one-time purchases processed securely through Paddle, our payment provider. By making a purchase, you agree to Paddle's Terms of Service.

Refunds: If you encounter technical issues that prevent your bookmarks from being organized, contact us at privacy@sortmarks.com for a refund. Refunds are not available for completed organizations where the service functioned as intended.

Service Limitations

Sortmarks is provided with the following limitations:

• No guarantee of uptime or availability
• Rate limits apply to prevent abuse (30 requests/minute for organization)
• Daily global usage limits may temporarily pause the service for all users when exceeded
• Maximum file size and bookmark count may be enforced
• AI categorization is not perfect and may produce errors
• Job results for large bookmark sets are stored encrypted for up to 48 hours, after which they are automatically deleted
• We reserve the right to refuse service or limit access

Intellectual Property

Your bookmarks remain your property. By using Sortmarks, you grant us a temporary license to process your bookmarks solely for the purpose of providing the organization service. This license terminates immediately upon completion of processing.

The Sortmarks application, including its code, design, and branding, is our property.

Third-Party Services

Sortmarks uses OpenAI's API to provide AI-powered categorization. By using our service, you acknowledge that your bookmark data (titles and domain names) will be processed by OpenAI according to their Terms of Use and Privacy Policy.

Payments are processed by Paddle, our Merchant of Record. Paddle handles all payment processing, invoicing, and sales tax/VAT compliance. By making a purchase, you agree to Paddle's Terms and Privacy Policy.

Job results may be temporarily stored in Vercel KV according to Vercel's Terms of Service. All data is encrypted before storage and automatically deleted after 48 hours.

Disclaimer of Warranties

Sortmarks is provided "as-is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Accuracy or completeness of AI categorization
• Uninterrupted or error-free operation
• Fitness for a particular purpose
• Non-infringement

Limitation of Liability

To the maximum extent permitted by law, Sortmarks and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data or bookmarks
• Loss of profits or business opportunities
• Service interruptions or errors
• Errors in AI categorization

You use the service at your own risk.

Privacy

Your use of Sortmarks is also governed by our Privacy Policy, which explains how we process your data.

Modifications to Service

We reserve the right to modify, suspend, or discontinue Sortmarks at any time without notice. We may also update these Terms of Service from time to time. Continued use of the service after changes constitutes acceptance of the updated terms.

Termination

We may terminate or suspend your access to Sortmarks immediately, without prior notice, if you breach these Terms of Service or engage in abusive behavior.

Governing Law

These Terms of Service shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.
